A. General Information

1. Provider and scope of the terms of use

1.1 provider of the online services "www.promundi.de" (hereinafter also referred to as "the service") and therefore contractual partner of the users of the service (hereinafter also referred to as "users") is Bitdorado OÜ Registry Code 14781194 Peterburi tee 47 Lasnamäe linnaosa, Tallinn Harju maakond 11415
1.2 The following terms and conditions contain the conditions and rules of conduct for the use of the service, support, participation in raffles and are binding for all legal transactions and similar actions, which are made between Bitdorado OÜ. and theuser. Furthermore, the terms and conditions regulate the relationship of the users among themselves, as far as the interaction and communication in and about the service is affected.
2. Supplementary terms and conditions These conditions are supplemented by conditions for individual raffles, as they are published on www.promundi.de.

B. Terms of use for the online service www.promundi.de

1. Registration, conclusion of contract and access data 1.1 The active use of the service is not permitted for people under 18 years of age and other natural persons who are not or only to a limited extent legally competent beyond passive use ("surfing").
1.2 Active use of the service requires registration of the user and the creation of a user account (hereinafter referred to as "account"). Bitdorado OÜ. provides an online form for this purpose. However, Bitdorado OÜ. reserves the right to reject the user's registration without giving reasons.
1.3 The user is not permitted to enter data from third parties. A multiple registration is not permitted.
1.4 When registering, the user also specifies a profile name and a password. Basically the profile name is a freely chosen user name. Inadmissible are such user names whose use violates the rights of third parties, especially rights to names or trademarks, or which are otherwise illegal or offend common decency.
1.5 The password, together with the e-mail address provided during registration, forms the access data of the user. The password must be kept secret and must not be disclosed to third parties.

2. Discontinuation of projects/permitted projects

2.1 The user is basically free to stop his or her planned activities, in case he or she would have a basic income. However, the user is obliged to Bitdorado OÜ. not to post any content that is of an illegal nature or illegal content or - for whatever reason - may not be carried out or advertised in the Federal Republic of Germany or only under certain conditions. Against this background, in particular projects which and/or their contents fall into the following categories are inadmissible:

• projects whose content and/or objectives are directed against the free democratic basic order or the idea of international understanding
• projects whose content discriminates against people because of their origin, appearance, skills, sexual orientation, gender, social background or age
• projects that describe or refer to cruel acts of violence against people or animals in a way that glorifies or trivialises such acts of violence or that depicts the cruel or inhuman nature of the act in a way that violates human dignity
• schemes which glorify war;
• projects which or their contents violate human dignity, in particular by depicting or describing people who are or were dying or who are or were subjected to severe physical or mental suffering, whereby an actual event is depicted without there being a legitimate interest in this form of depiction or reporting; consent is irrelevant;
• projects which, or the expected implementation of which, violate or infringe weapons laws on provider or winner side ;
• projects which depict or describe children or young people in unnatural gender-emphasized postures, which are pornographic, especially if they involve violence, the sexual abuse of children or young people or sexual acts of people with animals; this also applies to projects which even refer to or hint at such content and/or objectives;
• Projects through which games requiring a state licence are advertised (in particular games of chance), or which involve or advertise chain letters, pyramid schemes, betting or related matters
• Projects which are insulting, slanderous or otherwise defamatory and/or show racist, anti-Semitic, anti-Islamic tendencies
• Projects that violate the right to protection of privacy and the right to one's own image and/or threaten or otherwise put or would put pressure on others in any way would be carried out;

Theuser in view of this paragraph 2.1 is obliged to examine the projects he/she intends to stop.

3. Rules for other user content / user photos

3.1 The provisions of section 2.1 apply in full to all content that the user places on the service, i.e. in particular texts and images.
3.2 Theuserhas to pay particular attention to copyright and ancillary copyright positions of third parties if he/she is not the authorof the content in question.
3.3 The user's photo placed in the user's profile may only show the user himself or a concrete motive, but not other persons, as far as these persons are identifiable.

4. Rights of use for contents

4.1 The user who uploads the content to the service grants Bitdorado OÜ. transferable simple, spatially and temporally unlimited rights of use of the content to the extent necessary for the operation of the service.
4.2 Against this background, the User particular grants Bitdorado OÜ. the right to make the respective content technically available for retrieval in the service and to make the necessary reproductions (storage on the servers, etc.). In addition, the user Bitdorado OÜ. grants the right to edit the content in order to better present it on the website. Furthermore, Bitdorado OÜ. has the right to make the content publicly accessible, to broadcast and otherwise publicly reproduce the content as part of the service, including in particular making the content accessible or broadcasting it by transferring it to other users' fixed or mobile devices as part of automated subscription services (push services) or retrieval services (pull services) (e.g. via podcasting, RSS feed, Atom feed, XML interface or other technologies). The right to broadcast shall in particular also include the right to reproduce content in the service by continuous transmission of the data (streaming), including the possibility to design the stream in such a way that the data sent can be stored by the recipient.

5. Commercial use / Other impermissible behaviour

5.1 The service is for private use only. Use for commercial and/or business purposes is not permitted. This applies in particular to the offering of goods or services of any kind against payment or the invitation to submit a corresponding offer, and the naming of value-added service numbers (in particular 0900 numbers) or value-added text message numbers (Premium SMS) within the scope of the Service. This prohibition shall apply in the same way in the relationship between the users among themselves, provided that the communication in question is made using the Service and its functions, as well as to advertising for products and services offered by third parties against payment.
5.2 Furthermore, the user may not use any automatic or manual procedures to read out, store, process, change, forward or otherwise misuse data from the service. No e-mails may be intercepted.
5.3 TheThe User may not introduce viruses, Trojans and corresponding scripts and programs or similar malicious code into the Service. The sending of spam e-mails is also prohibited.
5.4 In particular, the publication, sending or other transmission of personal data of other users or third parties is also prohibited.

6. Newsletter / Advertising

Upon express request Bitdorado OÜ. sends the user reasonable intervals an email newsletter to his own email address, which contains editorial information from and about the offer of Bitdorado OÜ. (e.g. that a new basic income is drawn by lottery). In addition, Bitdorado OÜ. reserves the right to inform the user by e-mail about its own products and offers of third parties. The user has the possibility to unsubscribe from the newsletter at any time, for example by choosing the appropriate function in the newsletter itself, by removing the corresponding check mark on his profile page or by sending an email to support@bitdorado.exchange . The user also has the possibility to receive the newsletter without reference to offers of third parties by sending an e-mail to support@bitdorado.exchange.

7. Warranty and liability of the user/release with regard to illegal contents

7.1 Theuser warrants to Bitdorado OÜ. that he/she is entitled and able to transfer the rights to the extent determined by clause 6. TheThe User further warrants to Bitdorado OÜ. that he/she will not post content to the service whose subject matter or content violates clauses 4, 5 and 7.
7.2 The User is solely responsible for all content posted by him/her and for the existence of any legal positions required for this. Bitdorado OÜ. does not check the contents posted by the user principle. Further claims for damages by Bitdorado OÜ. remain unaffected.

8. Liability of Bitdorado OÜ.

Bitdorado OÜ. is liable in principle according to the statutory provisions. However, two restrictions apply: If damages of the user result from the loss of data, Bitdorado OÜ. is not liable, if the damages would have been avoided by a regular and complete backup of all relevant data by the user. In case of only slight negligence or omission, Bitdorado OÜ. is also not liable for contract-untypical or unforeseeable damages, unless the damage affects life, body or health.

9. Auxiliary persons

Bitdorado OÜ. reserves the right to use third parties to fulfill contractual obligations.

10. Breaches of the terms of use

Bitdorado OÜ. reserves the right to delete content that is inadmissible under these terms of use, as well as to warn users for violations of these terms of use and/or to temporarily or permanently block their user accounts in order to encourage users to comply with their obligations. Warnings and suspensions will be communicated to the user in text form. In addition an extraordinary notice of termination of the user relationship can be given.

11. Termination of the user agreement

11.1 The user relationship can be terminated by the user at any time, by Bitdorado OÜ. with a notice period of two weeks. Both parties reserve the right to terminate the contract without notice for good cause. Each notice of termination requires the text form.
11.2 After termination of the contract, all data of the User will be deleted, unless storage is required for legal reasons. A reactivation is therefore not possible (see https://bitdorado.exchange/privacy-policy/ for details).
11.3 If Bitdorado OÜ. blocks the user's account or declares an extraordinary termination, the user may not re-register for the service without the consent of Bitdorado OÜ.

C. Conditions for supporters

1. Principles

1.1 Bitdorado OÜ. mediates donations from the supporters to the recipients of basic income (beneficiaries) and collects donations for the realization of its non-profit research and educational purposes.
1.2 Supporters who have created a user account and issued a SEPA Direct Debit Mandate for recurring payments are called "Crypto-Angels" (https://www.promundi.de/cryptoangels).
1.3 All payments made by supporters (one-time payments, recurring payments and masternode or stakingrewards) in the SEPA Direct Debit Accounts are held in trust by Bitdorado OÜ. and are used on behalf of the donors exclusively for the payment of Unconditional Basic Income to the beneficiaries.
1.4 Donations are used by Bitdorado OÜ. exclusively for the realization of its charitable purposes.

2. provision on the use of payments from supporters

2.1 Supporters determine whether their one-time or ongoing payments are granted as a donation for the charitable purposes of Bitdorado OÜ. or as a gift to the lottery pot, or how a payment should be divided between the two purposes.
2.2 In the absence of a provision on the use, Bitdorado OÜ. is entitled to collect 50% of the payment as a donation. For payments over 1.000 € Bitdorado OÜ. will ask the supporter how the payment is to be used.

3. Payments into the lottery pot

3.1 Payments will be made by the supporter under the condition and instruction that Bitdorado OÜ. will hold these funds, together with all other payments into the lottery pot, in trust and separate from its other assets for the supporters and will forward them to recipients of Unconditional Basic Income as gifts from the supporters. In the case of payments into the Promundi Pools, the resulting rewards are used to pay out the Basic Income and cannot be reclaimed by the Supporter.
3.2 Supporters authorize Bitdorado OÜ. to select the recipients of their gifts from among the applicants. The selection is currently made by lot. The forwarding is anonymous. Bitdorado OÜ. will neither disclose the names of the donors to the beneficiaries nor the names of the beneficiaries to the donors.
3.3 The supporters authorize Bitdorado OÜ. to determine the amount of the gifts. At present, each beneficiary is drawn in a basic income of 1200 €, payable in 12 monthly instalments of 100 € each.
3.4 When forwarding the gifts, the payments received first are considered to be used first (first-in, first-out) and distributed equally to all recipients of the respective forwarding.
3.5 The supporters waive any claims for repayment of payments not yet forwarded. If Bitdorado OÜ. definitively discontinues the granting of unconditional basic income, any remaining balance of funds held in trust, which is less than the amount of a basic income last granted, may be donated to charitable associations.
3.6 Proof of proper use
Bitdorado OÜ. will document the proper administration and use of the funds by public block chain.

4. Donations

Donations to Bitdorado OÜ. will be used exclusively for the statutory charitable purposes. It is not possible to issue a donation receipt for donors ("donation receipt"). No donation receipt can be issued for donations to be forwarded to recipients of basic income.

D. Conditions for participation in raffles for unconditional basic income

1. Eligibility of participation

1.1 All persons who have reached the age of 14 years at the time of registration are eligible to participate. Persons under 18 years of age must be represented by one of their legal guardians when accepting the prizes.
1.2 All people who have registered at www.promundi.de, filled in the raffle information in their profile, confirmed their participation for the next (or as Crypto-Angel for all following) raffle(s) in their profile, accepted these terms and conditions and have given their consent to data processing, are eligible to participate in the current raffle.
1.3 People who have not contributed to the financing of the basic income per can also explicitly take part. There is therefore no connection between the support and the possibility of winning.
1.4 Each person can only participate once per raffle via the website. Excluded from this are persons with custody of children, provided that the children have not yet reached the age of 14 on the day of the raffle. These persons may participate in the raffle once for themselves and once for each child who has not yet reached the age of 14 on the day of the raffle. However, several persons with custody rights may not take part in the raffle for the same child.
1.5 A valid participation in a raffle is only given if the full name (all first and last names, as on a valid official identification document or birth certificate) and the date of birth of the participants are completely and correctly stated in the registration form.
1.6 Participation in a raffle is not related to the purchase of a product or the use of a service.
1.7 Minor participants please ask their legal guardians if they agree to participate.

2. Exclusion from participation

2.1 People who already receive a basic income within the meaning of these conditions on the day of the draw are excluded from participation. Excluded are the 3 beta-test draws, which have been marked as such. These are not counted.
2.2 If persons having custody win for one or more of their children, participation is excluded for this child only for the duration of the draw. If persons with custody win for themselves, they may continue to participate for their minor children.
2.3 In case of a violation of these terms and conditions of participation, Bitdorado OÜ. reserves the right to exclude persons from participation in raffles.
2.4 If the raffle or participation in it is prohibited by law or other regulations at the place of participation, participation from that place is unfortunately not possible.

3. Execution of the raffle

3.1 The dates of the raffles and the number of basic incomes drawn in each case are announced at www.promundi.de.
3.2 The raffles will be filmed and then made available online for viewing. The exact date of the raffle will be announced at www.promundi.de.
3.3 The raffles can also be shown via livestream on a publicly accessible channel (e.g. https://Bitstreams.tv) and subsequently made available online for viewing.
3.4 When participating in a raffle, all participants will receive lottery ticket numbers which they can view in their profile on www.promundi.de. In the public raffle, a winning number is generated for each basic income to be drawn. The participants with ticket numbers corresponding to one of these winning numbers have won.
3.5 Legal recourse, e.g. due to alleged or actual errors in the execution of the raffle, is excluded.

4. Processing

4.1 The winners will be notified by email and their profile name and profile photo (if uploaded) will be published on www.promundi.de The winners expressly agree to this form of publication.
4.2 The winners are obliged to prove that the information provided for participation (full name, date of birth) is true. These data will not be published.
4.3 If winners do not respond within three weeks after receipt of the prize notification, the claim to the prize will be forfeited. The participants are responsible for the correctness of the e-mail address provided.
4.4 The basic income is paid out by transfer to an account in the SEPA payments area. Transaction costs or fees for transfer by other means will be deducted from the profit.
4.5 . There is no legal entitlement to payment of Unconditional Basic Income and no notification of the prize is required.

5. Premature termination of the raffle

5.1 Bitdorado OÜ. reserves the right to cancel or terminate a raffle at any time without prior notice. Bitdorado OÜ. particularly makes use of this possibility if for technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software) or for legal reasons a proper execution of the raffle cannot be guaranteed. If such a termination was caused by the behaviour of aparticipant, Bitdorado OÜ. can demand compensation from this person for the damage incurred.
5.2 Claims for performance and damages of the participant in the event of premature termination of the lottery are excluded.

6. Winnings

6.1 The winners will receive an Unconditional Basic Income, which will be granted in monthly amounts for a certain period of time. The number, amount and term of the basic income drawn will be announced on www.promundi.de before each raffle.
6.2 The payment will be made at the beginning of the month. The first month of payment is the month following the month of winning, but at the earliest the first month after successful verification of personal data.
6.3 A person can only win once in the same raffle. If a person with custody of his or her child(ren) takes part, however, both the person himself or herself and each child can win once. If a person has already won a lifetime basic income (exception: beta raffles), the person can only take part in raffles for temporary basic income.
6.4 There is no entitlement to a one-off payment of the winning amount under any circumstances.

7. Supplementary conditions for individual raffles

Further terms and conditions for individual raffles will be announced with the announcement of the respective raffle on www.promundi.de.

E. Final provisions

1. Privacy Protection

2. Liability

2.1 The announcement of the winners is without guarantee.
2.2 Bitdorado OÜ. as the organizer is not liable in any form for direct or indirect damages resulting from participation in the raffle or the inaccessibility of the internet server, unless these are due to gross negligence or intentional action, which is the responsibility of the organizer.

3. Amendment of these conditions, applicable law

3.1 Bitdorado OÜ. reserves the right to change the conditions at any time and without giving reasons. The new terms and conditions will be sent to theuser by e-mail.
3.2 The new terms of use shall be deemed agreed upon if the user does not object to their validity within six weeks after receipt of the email. The objection must be in text form. Bitdorado OÜ. will separately inform the user in the e-mail about the possibility of objection, the deadline and the consequences of the users inactivity. If the user objects, each party has the right to terminate the user agreement in text form with the period of notice applicable to a regular termination, which the user also has the right to do via the function "irrevocably delete my account".
3.3 The possibility of changing the terms and conditions in accordance with the above provisions does not apply to changes that affect the content and scope of the core usage options of the service to the detriment of theuser, nor to the introduction of new obligations for theuser that were not previously laid out in the terms and conditions. If changes to the conditions are to be made in this regard, Bitdorado OÜ. will offer to continue the user relationship under the new conditions.
3.4 The contractual relationship between Bitdorado OÜ. and the user/participant/supporter as well as these terms and conditions are exclusively governed by the law of Estonia
